Terms of Service

1. Acceptance of Terms

By accessing or using CareBeaconOS ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform. These terms apply to all users including NDIS providers, allied health professionals, support coordinators, and independent contractors. We may update these terms from time to time — continued use after changes constitutes acceptance.

2. Service Description

CareBeaconOS is a software-as-a-service platform providing NDIS provider management, allied health directory listings, support coordinator tools, roster and timesheet management, NDIS invoicing, SCHADS Award payroll calculations, and AI-assisted features. The Platform is provided by Leading with Kindness Services Pty Ltd (ABN 90 684 056 148). We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. User Obligations

You agree to provide accurate registration information, maintain the security of your account credentials, use the Platform only for lawful purposes, not attempt to reverse-engineer or scrape the Platform, and not share access credentials with unauthorised persons. You are responsible for all activity that occurs under your account. You must promptly notify us of any unauthorised access or security breach.

4. NDIS Provider Responsibilities

NDIS providers using the Platform remain solely responsible for compliance with the NDIS Act 2013, NDIS Practice Standards, NDIS Code of Conduct, and all relevant state and territory legislation. CareBeaconOS is a software tool — it does not constitute legal, compliance, or financial advice. Invoice amounts, support item codes, and participant budgets must be verified by your organisation before submission to the NDIS or plan managers. We are not responsible for rejected claims or compliance breaches arising from incorrect data entry.

5. Payment Terms

Subscription fees are billed monthly in advance in Australian dollars. Fees are non-refundable except as required by the Australian Consumer Law. Your subscription renews automatically unless cancelled at least 24 hours before the renewal date. We reserve the right to suspend access for overdue accounts after 7 days written notice. All prices are inclusive of GST where applicable.

6. Intellectual Property

CareBeaconOS, its branding, software, and content are owned by Leading with Kindness Services Pty Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform during your subscription. Data you input into the Platform (participant records, documents, shift notes) remains your property. We may use anonymised, aggregated data to improve the Platform.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Leading with Kindness Services Pty Ltd is not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability for any claim is limited to the fees paid by you in the three months preceding the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, or for any liability that cannot be excluded under the Australian Consumer Law.

8. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
